§ 1 Scope
(1) These terms apply to all contracts for personalised digital images ("AstroCards", e.g. Dating Receipt or Big Three) concluded via cosmolytic.com between Anonyfox e. K., owner Maximilian Stroh, Zehntland 2d, 21079 Hamburg, Germany ("Provider") and the customer.
(2) Customers may be consumers (§ 13 BGB) or businesses (§ 14 BGB). Deviating terms of the customer do not apply unless the Provider expressly agrees in writing.
(3) All other content on cosmolytic.com (e.g. daily and yearly horoscopes, tarot, reference pages and sky tools) is free and can be used without registration. Purchases on the language hubs sterne.cosmolytic.com, stars.cosmolytic.com and sterren.cosmolytic.com are governed by the terms published there.
§ 2 Conclusion of contract and contract language
(1) The presentation of AstroCards on the website is not a binding offer.
(2) On the product page the customer enters the data needed for the card (date of birth; for Big Three also the time of birth; for some cards optionally a second date of birth). Before the payment form opens, the customer ticks a checkbox on cosmolytic.com to give the consent described in § 5 (2). The Stripe payment form then opens on cosmolytic.com. By completing the payment the customer makes a binding offer.
(3) The contract is concluded when the Provider creates and provides the card after receiving payment.
(4) The contract language is German. The English and Dutch versions of these terms, the withdrawal policy and the privacy policy are provided for information; the German version prevails. Mandatory consumer protection rules remain unaffected.
(5) The Provider does not store the contract text separately. The customer can view, save and print these terms on cosmolytic.com at any time. As contract confirmation the customer receives the Stripe payment receipt by email; the card also remains available on its personal page.
§ 3 Prices and payment
(1) The price shown on the product page applies. All prices are final prices in euros. No VAT is charged under § 19 UStG (German small business scheme).
(2) This also applies to consumers resident in another EU member state: the prices shown are final prices and no VAT is shown.
(3) Payment is made in advance via Stripe using the payment methods offered in the payment form (e.g. card, PayPal, Apple Pay or Amazon Pay; the selection may vary by device and country).
§ 4 Performance and delivery
(1) The card is created automatically right after payment and provided as an image (PNG) on a personal page with its own address (e.g. cosmolytic.com/en/astro-cards/dating-receipt/…). From there the customer can download and share the image. The card is not sent by email.
(2) The interpretive texts on the card are written automatically by software (a language model) from the calculated sky data; they are not written individually by a person.
(3) The customer is responsible for the accuracy of the birth data entered.
(4) Anyone who knows the address of the personal page can open it. The customer decides who receives the link.
(5) The customer receives a simple, non-transferable, perpetual right of use for personal purposes. Sharing the card on social media and with other people is expressly allowed; resale is not permitted.
§ 5 Right of withdrawal and early expiry
(1) Consumers have a right of withdrawal as set out in the withdrawal policy. Businesses have no right of withdrawal.
(2) Digital content not supplied on a tangible medium: the consumer's right of withdrawal expires under § 356 (5) BGB once the Provider has begun performance after the consumer has (a) expressly agreed that the Provider begins performance before the withdrawal period ends, and (b) acknowledged that this consent means losing the right of withdrawal once performance begins, and the Provider has (c) provided a contract confirmation under § 312f BGB. The customer gives consent and acknowledgement on cosmolytic.com before the payment form opens. Creation of the card starts immediately after payment is received. The contract confirmation is provided with the Stripe payment receipt by email and on the card's personal page.
(3) AstroCards are created individually from the customer's data. There is no right of withdrawal for them under § 312g (2) no. 1 BGB; alternatively paragraph 2 applies.
§ 6 Warranty
(1) For consumers the statutory provisions apply, in particular §§ 327 et seq. BGB for digital products.
(2) For businesses the limitation period for claims for defects is one year from delivery; this does not apply to claims under § 7.
§ 7 Liability
(1) The Provider is liable without limitation for intent, gross negligence, injury to life, body or health and under the Product Liability Act.
(2) For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded.
(3) AstroCards and all other astrological content are interpretive guidance for self-reflection and entertainment. They contain no guarantee of events and do not replace medical, psychological, legal or financial advice.
§ 8 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Hamburg.
(3) The EU Online Dispute Resolution platform was discontinued on 20 July 2025. The Provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
(4) If individual provisions are invalid, the remainder of the contract remains valid.
(5) Information on the processing of personal data is in the privacy policy.
